1. Introduction and Acceptance of Terms

1.1 Scope of Agreement

Welcome to the LoanSahi personal loan application ("Application," "App," or "Platform") owned and operated by BENEVOLENT BPO SERVICES (OPC) PRIVATE LIMITED (hereinafter referred to as "Company," "we," "our," or "Platform"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you and the Company, governing your access to and use of the LoanSahi application and related services.

1.2 Acceptance of Terms

By downloading, installing, accessing, or using the LoanSahi application, you confirm that:

  • 1.2.1 You are at least 18 years old and have full legal capacity
  • 1.2.2 You are a resident of India
  • 1.2.3 You have read, understood, and agree to be bound by these Terms
  • 1.2.4 You agree to comply with all applicable Indian laws and regulations
  • If you disagree with any part of these Terms, please stop using this application immediately.

    1.3 Platform Nature Declaration

    Important Notice: LoanSahi is a digital platform developed and operated by BENEVOLENT BPO SERVICES (OPC) PRIVATE LIMITED as a technology platform provider. All loan products offered through this platform are provided by our partner Dealing Beneficial Financial Services Pvt Ltd (a registered and regulated Non-Banking Financial Company in India under the Reserve Bank of India (RBI), hereinafter referred to as "NBFC Partner" or "Loan Provider").

    Platform Role: We act solely as a technology and platform provider, responsible for:

  • - Application development, maintenance, and updates
  • - Daily platform operations and management
  • - User technical support and service
  • - Customer service assistance
  • NBFC Partner Role: Dealing Beneficial Financial Services Pvt Ltd, as the loan provider, is fully responsible for:

  • - Loan product design and pricing
  • - User credit assessment and risk analysis
  • - Loan application approval or rejection
  • - Loan fund disbursement
  • - Repayment processing and account management
  • - Collection activities and risk management
  • - Compliance with all applicable financial regulations
  • 2. Eligibility Criteria

    To use our services, you must meet all of the following conditions:

  • 2.1 Age Requirement: At least 18 years old
  • 2.2 Residence Requirement: Resident of India
  • 2.3 Income Requirement: Have a stable source of income
  • 2.4 Credit History: Have a good credit record (according to the NBFC Partner's assessment standards)
  • 2.5 Document Requirement: Able to provide valid identity verification documents
  • 3. Service Description

    3.1 Service Content

    The LoanSahi platform provides the following services:

  • 3.1.1 Loan Application Platform: Digital loan application and submission interface
  • 3.1.2 Document Upload: Secure document upload and verification system
  • 3.1.3 Application Tracking: Real-time loan application status tracking
  • 3.1.4 Customer Support: In-application customer support service
  • 3.1.5 Repayment Management: View repayment plans and make repayments through the application
  • 3.2 Loan Product Details

    Loan products offered through the LoanSahi platform have the following characteristics:

  • 3.2.1 Loan Amount
  • - Minimum Loan Amount: ₹1,000
  • - Maximum Loan Amount: ₹300,000
  • - The actual approved loan amount will be determined based on your credit assessment results
  • 3.2.2 Loan Tenure
  • - Minimum Tenure: 4 months
  • - Maximum Tenure: 36 months
  • - You can choose a repayment term suitable for you during application
  • 3.2.3 Interest Rate
  • - Annual Interest Rate Range: 18% - 28%
  • - The actual applicable interest rate will be determined based on the following factors:
  • - Your credit score and credit history
  • - Loan amount and tenure
  • - Income level and employment stability
  • - NBFC Partner's risk assessment model
  • 3.2.4 Fee Structure
  • The loan may involve the following fees (specific fees will be clearly stated in the loan disclosure document):

  • - Service Fee: A certain percentage of the loan amount
  • - GST: Goods and Services Tax applicable under Indian tax laws
  • - Overdue Fee: Fees that may be incurred if not repaid on time
  • Note: All fees will be clearly disclosed during the loan application process and detailed in the loan disclosure document.

    3.3 Service Limitations

  • 3.3.1 We reserve the right to modify, suspend, or terminate any service features at any time without prior notice
  • 3.3.2 We do not provide any warranties regarding service continuity, timeliness, or security
  • 3.3.3 We may temporarily interrupt services due to maintenance, upgrades, or other reasons
  • 4. User Accounts

    4.1 Account Registration

    To use our services, you need to:

  • 4.1.1 Download the LoanSahi application
  • 4.1.2 Register an account using a valid mobile number
  • 4.1.3 Provide accurate, complete, and up-to-date personal information
  • 4.2 Account Security

    You are responsible for:

  • 4.2.1 Protecting your login credentials (username and OTP)
  • 4.2.2 Preventing unauthorized access to your account
  • 4.2.3 Immediately notifying us of any unauthorized account use
  • 4.2.4 Ensuring you log out of the application on your device
  • 4.3 Account Accuracy

    You warrant that all information provided is:

  • 4.3.1 True, accurate, complete, and up-to-date
  • 4.3.2 Not misleading or deceptive
  • 4.3.3 Does not infringe any third-party rights
  • If we suspect information is inaccurate or fraudulent, we reserve the right to suspend or terminate your account.

    5. Loan Application Process

    5.1 Application Steps

  • 5.1.1 Download and Register: Download the LoanSahi application and create an account
  • 5.1.2 Complete Application Form: Provide personal information, employment details, and financial information
  • 5.1.3 Upload Documents: Upload required identity verification documents
  • 5.1.4 Submit Application: Review and submit your loan application
  • 5.1.5 Credit Assessment: The NBFC Partner will conduct credit assessment
  • 5.1.6 Approval Decision: You will receive notification of loan approval or rejection
  • 5.1.7 Loan Agreement: If approved, you can reconfirm loan information in the app
  • 5.1.8 Fund Disbursement: After confirming acceptance of the loan, the loan amount will be disbursed to your designated bank account
  • 5.2 Application Processing Time

  • - Approval Time: Typically completed within 24 hours, with the fastest approval in 1-5 minutes
  • - Fund Disbursement: Within 24-48 hours after approval
  • Actual processing time may vary depending on application complexity, document completeness, verification requirements, and bank processing time.

    5.3 Application Status

    You can through the application:

  • 5.3.1 Track your application status in real-time
  • 5.3.2 View assessment progress
  • 5.3.3 Receive status update notifications
  • 5.3.4 View approval decisions and loan terms
  • 6. Repayment Terms

    6.1 Repayment Responsibility

  • 6.1.1 You are responsible for repaying the loan according to the time and amount specified in the loan agreement
  • 6.1.2 Repayments will be initiated by you through manual payments
  • 6.1.3 You should ensure sufficient funds are available in your repayment account
  • 6.2 Repayment Schedule

  • 6.2.1 The repayment schedule will be displayed in the loan disclosure document and within the APP
  • 6.2.2 The repayment amount includes principal and interest portions
  • 6.3 Late Repayment

    If you fail to repay on time:

  • 6.3.1 Late fees or delayed payment charges may be incurred
  • 6.3.2 Your credit score may be affected
  • 6.3.3 Collection actions may be initiated
  • 6.3.4 Legal proceedings may be initiated
  • Specific consequences will be detailed in the loan disclosure document.

    6.4 Early Repayment

    You may choose to repay the loan early:

  • 6.4.1 Early repayment does not require payment of any additional fees
  • 6.4.2 You can directly initiate repayment operations in the app
  • 7. Fees and Charges

    7.1 Fee Transparency Principle

    We are committed to:

  • 7.1.1 Disclosing all fees during the loan application process
  • 7.1.2 Clearly listing all fees in the loan disclosure document
  • 7.1.3 Not charging any hidden fees
  • 7.2 Main Fee Types

  • 7.2.1 Service Fee: One-time fee (including: Processing Fee, Credit Investigation Fee, Risk Review Fee, Technical Service Fee), typically a percentage of the loan amount
  • 7.2.2 Interest: Calculated based on loan amount, tenure, and interest rate
  • 7.2.3 GST: Applicable under current Indian tax laws
  • 7.2.4 Overdue Fee: If not repaid on time
  • 8. Privacy and Data Protection

    8.1 Privacy Policy

    Our collection, use, storage, and sharing of your personal information are governed by our separate Privacy Policy, which is incorporated into these Terms. Please read the Privacy Policy carefully to understand our practices.

    8.2 Information Use

    You agree that we and our NBFC Partner:

  • 8.1.1 Use your information for credit assessment and risk analysis
  • 8.1.2 Share information with credit information companies
  • 8.1.3 Share necessary information with third-party service providers to provide services
  • 8.1.4 Disclose information when required by law
  • 8.3 Credit Information Sharing

    You specifically agree that:

  • 8.3.1 Your loan information may be shared with NBFCs we cooperate with
  • 8.3.2 Your repayment behavior will affect your credit score
  • 8.3.3 Late repayments may negatively impact your credit record
  • 9. User Obligations and Prohibited Behaviors

    9.1 User Obligations

    You agree to:

  • 9.1.1 Provide true, accurate, and complete information
  • 9.1.2 Promptly update your personal information
  • 9.1.3 Repay all due amounts on time
  • 9.1.4 Comply with all applicable laws and regulations
  • 9.1.5 Protect your account security
  • 9.2 Prohibited Behaviors

    You shall not:

  • 9.2.1 Provide false or misleading information
  • 9.2.2 Use another person's identity or documents
  • 9.2.3 Engage in fraudulent activities
  • 9.2.4 Attempt to circumvent our security measures
  • 9.2.5 Use the application for illegal purposes
  • 9.2.6 Interfere with or disrupt services
  • 9.2.7 Access other users' accounts without authorization
  • 10. Intellectual Property

    10.1 Ownership

  • 10.1.1 The LoanSahi application, website, logos, content, and all related intellectual property rights are owned by the Company
  • 10.1.2 You are granted a limited, non-exclusive, non-transferable license to access and use the services for personal use purposes only
  • 10.1.3 You shall not copy, modify, distribute, or create derivative works without our explicit written consent
  • 10.2 User Content

    You retain ownership of any content you submit to the platform. However, by submitting content, you grant us a license to use, store, and display that content solely for providing services.

    11. Limitation of Liability

    11.1 Services Provided "As Is"

    The services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

    11.2 Limitation of Liability

    To the maximum extent permitted by law, the Company or its affiliates, directors, employees, agents, or suppliers shall not be liable for:

  • 11.1.1 Indirect, incidental, special, consequential, or punitive damages
  • 11.1.2 Loss of profits, data loss, or other intangible losses
  • 11.1.3 Any damages arising from use or inability to use the services
  • 11.1.4 Unauthorized access to or alteration of your transmissions or data
  • 11.1.5 Statements or conduct of any third party regarding the services
  • 12. Indemnification

    You agree to indemnify, defend, and hold harmless the Company and its affiliates, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising from:

    We reserve the right to terminate or suspend your access to the services at any time without prior notice, for reasons including but not limited to:

  • 13.1.4 Prolonged inactivity
  • 13.2 Termination Consequences

    Upon termination:

  • 13.2.1 Your right to access the services will immediately cease
  • 13.2.2 You will still be responsible for repaying all outstanding loans
  • 13.2.3 We may retain your information for legal and regulatory purposes
  • 14. Dispute Resolution

    14.1 Negotiation Resolution

    Any disputes shall first be resolved through amicable negotiations between the parties. If disputes cannot be resolved within 30 days, they shall be resolved in the manner specified in these Terms.

    14.2 Arbitration

    If negotiation fails, disputes shall be submitted to a sole arbitrator appointed under the Indian Arbitration and Conciliation Act (1996) for final and binding arbitration. The arbitration venue shall be Delhi, and the arbitration language shall be English.

    14.3 Jurisdiction

    Notwithstanding the arbitration clause, both parties agree that any disputes related to intellectual property or injunctive relief may be subject to the exclusive jurisdiction of courts in Delhi.

    15. General Terms

    15.1 Complete Agreement

    These Terms, together with our Privacy Policy, constitute the complete agreement between you and us regarding the services, superseding all prior oral or written agreements.

    15.2 Severability

    If any term is found to be invalid or unenforceable, that term shall be modified to the minimum extent necessary, and the remaining terms shall remain in full force and effect.

    15.3 Force Majeure

    We shall not be responsible for service interruptions or delays caused by any reasons beyond our reasonable control, including but not limited to natural disasters, war, terrorist acts, government actions, epidemics, cyber attacks, or technical failures.

    15.4 Waiver of Rights

    Our failure to enforce any provision of these Terms shall not constitute a waiver of that right or any other rights.

    15.5 Assignment

    You may not assign your rights or obligations without our prior written consent. We may assign our rights and obligations without your consent.

    15.6 Notices

  • 15.7 Language

    These Terms are provided in English. If there is any conflict between translated versions and the English version, the English version shall prevail.
